Official Sweepstakes Rules & Winner Terms: Nevada Grand Opening IVF Sweepstakes

These Official Rules & Winner Terms (“Rules”) govern The Nevada 36 Sweepstakes (the “Promotion”) offered by New Direction Fertility Centers (“Sponsor”). By participating, entrants agree to be bound by these Rules and the decisions of the Sponsor, which are final and binding in all respects. Location-Specific Promotion: This Promotion (including all Prizes) is valid only for fertility services performed at Sponsor’s New Direction Fertility Centers Las Vegas, Nevada location and specifically excludes (and may not be used, redeemed, or performed at) Sponsor’s Gilbert, Chandler, Scottsdale, Avondale, and San Diego locations.

1. ELIGIBILITY

The Promotion is open to all residents of the United States who are eighteen (18) years of age or older at the time of entry. Void where prohibited by law. Employees of New Direction Fertility Centers, its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members are not eligible to participate. Winning a prize is contingent upon fulfilling all medical and legal requirements set forth herein. Cash Patients Only: This Promotion is strictly for cash-pay patients and is not applicable to patients using insurance coverage (including, without limitation, any insurance benefits, insurance reimbursement, or third-party payor coverage).

2. PROMOTION PERIOD

The Promotion begins on the date of the first teaser announcement and concludes ten (10) days following the official Grand Opening of the Las Vegas, Nevada clinic location (the “Promotion Period”). All entries must be received during the Promotion Window as defined by the Sponsor’s social media channels.

3. HOW TO ENTER

Participants must comment on the specified Sponsor social media post during the Promotion Period. Eligible participants will receive a Direct Message (DM) with a Google Form link to complete their entry. All entries must be submitted through the Google Form.

  • Bonus Entries: Entrants may earn additional entries by tagging friends or sharing the promotion to their “Story” as specified in the marketing materials.
  • Selection Process: Winners will be selected by random drawing from all eligible Google Form submissions. AI-assisted tools may be used to conduct the random selection. No story submission is required, and no judging criteria will be used.

4. PRIZE DESCRIPTIONS AND LIMITATIONS

The following prizes (the “Prizes”) will be awarded. All Prizes are subject to the “General Prize Exclusions” listed in Section 5, and any additional limitations stated in the applicable prize tier below.

A. Grand Prize: One (1) Full IVF Cycle (100% Free)

Includes: clinical monitoring, egg retrieval, and one (1) embryo transfer.
Excludes: consultations (initial or follow-up), all medications, anesthesia (winner responsible for a $500 anesthesia fee), all pre-cycle diagnostic testing and workup (including labs/ultrasounds performed prior to cycle start), all PGT testing (including PGT-A/PGD/PGT-M), embryo glue, and all storage (including embryo storage and any sperm and/or egg storage). For clarity, storage is not included in the Free IVF prize (unlike certain other promotional plans that may include a storage period).

B. Runner Up Prize: Five (5) 1/2 Off IVF Cycles

Winners receive a 50% discount on the Sponsor’s standard $6,500 IVF cycle package (the “Standard Package”). Includes everything included in the Standard Package (Ultrasounds/Bloods, Teaching, Retrieval, Assisted Hatching, Freezing, Thawing, 1st Transfer, and 1 Year Storage).
Excludes: PGT testing, medications, anesthesia, and all pre-cycle diagnostic testing/workup.

C. Budget-Saver Prize: Ten (10) IVF Cycles for $5,000

Winners are entitled to one (1) IVF cycle for a flat fee of $5,000 based on the Sponsor’s Standard Package. Includes everything included in the Standard Package (Ultrasounds/Bloods, Teaching, Retrieval, Assisted Hatching, Freezing, Thawing, 1st Transfer, and 1 Year Storage).
Excludes: PGT testing, medications, anesthesia, and all pre-cycle diagnostic testing/workup.

D. “Double Chance” Safety Net: Twenty (20) BOGO Cycles

If a winner completes a full IVF cycle (the “Initial Cycle”), utilizes all embryos created during that cycle through transfers, and does not achieve a clinical pregnancy that reaches at least twenty (20) weeks gestation, the Sponsor will provide one (1) subsequent IVF cycle at no cost (the “Second Cycle”).

  • The Second Cycle excludes medications, diagnostic testing (including pre-cycle testing/workup), PGT testing, anesthesia, and storage.
  • The Second Cycle includes retrieval and one (1) embryo transfer only. Any additional transfers from embryos created in the Second Cycle are not included and will be charged at the regular clinic rate.
  • For clarity, the “Initial Cycle” includes all transfers of embryos created during the Initial Cycle for purposes of determining whether the “Double Chance” criteria has been met.

5. GENERAL PRIZE EXCLUSIONS

Unless otherwise expressly stated in the prize description, none of the Prizes include the following:

  • Initial and ongoing consultations.
  • Medications (fertility drugs, etc.).
  • Anesthesia services.
  • Outside diagnostic testing (blood work, etc.).
  • Preimplantation Genetic Testing (PGT-A/PGD/PGT-M).
  • Add-on treatments (e.g., embryo glue, Zymōt, etc.).
  • Storage fees for extra embryos, sperm, or eggs beyond the initial cycle period.
  • Travel, lodging, or incidental expenses.

6. MEDICAL SUITABILITY AND CLINICAL DISCRETION

Medical Qualification: All Prizes are subject to a medical screening and clearance by a New Direction Fertility Centers physician. The Sponsor reserves the right, in its sole clinical discretion, to determine if a winner is a suitable candidate for IVF treatment.

  • If a selected winner is deemed medically unfit or otherwise medically disqualified for the applicable treatment, the prize will be awarded to the next eligible runner-up/alternate winner, as determined by the Sponsor.
  • Outstanding Balances Requirement: All prior and outstanding balances owed by a winner (or, if applicable, the winner’s spouse/partner receiving services in connection with the Prize) to New Direction Fertility Centers must be paid in full before the winner may claim, schedule, redeem, or otherwise utilize any Prize awarded under this Promotion.
  • Non-Transferable: Prizes cannot be sold, assigned, or transferred to any other person, except as may be required by law or expressly approved in writing by the Sponsor.
  • Expiration: Treatment must be initiated within twelve (12) months of the winner announcement.

7. TAXES AND 1099 REPORTING

The fair market value of the Prizes is taxable as income. Winners are solely responsible for all federal, state, and local taxes. Pursuant to IRS regulations, the Sponsor will issue an IRS Form 1099-MISC to winners for the value of the Prize awarded. Winners must provide the Sponsor with a valid Social Security Number or Taxpayer ID before the Prize can be redeemed.

8. PUBLICITY AND PRIVACY

By entering, participants grant New Direction Fertility Centers the right to use their submitted stories, names, and likenesses for marketing and promotional purposes without further compensation, unless prohibited by law. Winners may be required to participate in a “Live Lab Tour” or Grand Opening announcement.

9. RELEASE OF LIABILITY

By participating, entrants release and hold harmless New Direction Fertility Centers, its officers, directors, and employees from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with the Promotion or receipt or use of any Prize. This includes, but is not limited to, the results of medical procedures.

10. GOVERNING LAW

These Rules shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles. Any disputes shall be resolved in the courts located in Clark County, Nevada.

11. WINNER NOTIFICATION

Winners will be announced and contacted on April 1st via Direct Message or the contact information provided at the time of entry. Winners will have seven (7) days from the notification date to claim their Prize. If a winner does not respond within seven (7) days, an alternate winner may be selected.

Current Nevada Clinic Patients: Patients currently undergoing an IVF cycle at the Sponsor’s Nevada clinic who have already paid are eligible to apply an awarded Prize to their current treatment. However, if an IVF cycle has already been completed, the Prize cannot be applied retroactively to that specific completed cycle.
